CINEFLOW TERMS OF SERVICE

These Terms of Service govern your use of the Cineflow website at www.cineflowww.com and your purchase, download and use of digital products made available through Cineflow.

By accessing the website, creating an account or purchasing a product, you agree to these Terms.

1. About Cineflow

Cineflow provides digital products and creative assets for filmmakers, editors, content creators and other creative professionals.

Products may include sound effects, sound packs, LUTs, presets, templates, music related assets and other downloadable digital content.

2. Digital Products

All products sold through Cineflow are digital unless expressly stated otherwise.

No physical product will be shipped.

After successful payment, digital products may be made available through immediate download, customer account access, email delivery or another digital delivery method.

You are responsible for ensuring that your device, software and workflow are compatible with the product requirements stated on the relevant product page.

3. Licence

Purchasing a Cineflow product gives you a licence to use that product.

You do not acquire ownership of the underlying files, intellectual property, copyright, trademarks or other proprietary rights.

Unless a different licence is expressly supplied with a product, your purchase grants you a limited, non exclusive, non transferable licence to use the product in your own personal or commercial creative projects.

You may incorporate Cineflow assets into completed creative works including films, advertisements, social media content, branded content, documentaries, online videos and other audiovisual productions.

4. Prohibited Use

You may not:

• Resell or redistribute Cineflow products.

• Share purchased files with another person or business.

• Upload purchased files to file sharing platforms, marketplaces, libraries or public repositories.

• Sell the original files or substantially unchanged versions of them.

• Claim ownership or authorship of Cineflow products.

• Package Cineflow products into another digital asset pack or competing product.

• Transfer, sublicense or give your licence to another person unless expressly permitted.

• Circumvent any access, download or licensing restrictions applied to the products.

You may provide completed project files to a client where the Cineflow asset forms part of a larger completed creative work.

The original standalone Cineflow source files may not be transferred to the client unless the applicable licence expressly permits this.

5. Accounts

Where account functionality is available, you are responsible for maintaining the security of your account and login information.

You may not allow another person to use your account to access products they have not independently licensed.

We may suspend or terminate accounts where we reasonably believe that fraud, unauthorised sharing, redistribution or another violation of these Terms has occurred.

6. Pricing and Payment

Prices displayed on the website are those applicable at the time of purchase.

Cineflow may change prices, promotions, bundles and product availability at any time.

Any price change will not affect an order that has already been successfully completed.

Orders are considered complete once payment has been successfully processed.

7. Refunds

Due to the nature of downloadable digital products, purchases are generally final once the product has been supplied, accessed or downloaded.

Refunds may be considered where a customer has been charged incorrectly, has not received the purchased product due to a technical issue, or has received a materially defective or incorrect product that Cineflow cannot reasonably replace or correct.

Nothing in these Terms limits consumer rights that cannot lawfully be excluded under applicable South African law.

8. Intellectual Property

All content made available through Cineflow, including digital products, sound recordings, sound effects, designs, graphics, photographs, branding, product names, website content and other creative material, remains the intellectual property of Cineflow or the relevant rights holder.

Except for the licence expressly granted following purchase, no intellectual property rights are transferred to you.

9. Copyright Infringement and Unauthorised Distribution

Cineflow reserves the right to investigate suspected piracy, unauthorised distribution, account sharing or infringement of its intellectual property.

Where infringement occurs, Cineflow may revoke the applicable licence, restrict account access, remove download access and pursue remedies available under applicable law.

10. Product Availability

We may modify, replace, update or discontinue products at our discretion.

Purchasing a product does not guarantee permanent hosting or permanent access to download that product.

Customers should securely store copies of products they have purchased.

11. Third Party Services

Cineflow may use third party providers for payment processing, hosting, digital delivery, analytics and other services.

Your use of those services may also be subject to the relevant provider's terms and privacy practices.

Cineflow is not responsible for interruptions or failures caused solely by third party services outside our reasonable control.

12. Disclaimer

Digital products are supplied for creative use.

While we take reasonable steps to ensure products function as described, we do not guarantee that every product will be compatible with every device, application, operating system or workflow.

You are responsible for reviewing stated compatibility requirements before purchasing.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Cineflow will not be liable for indirect, incidental or consequential loss resulting from the use or inability to use a product.

Nothing in these Terms excludes liability or consumer rights where such exclusion is prohibited by law.

14. Promotions and Discount Codes

Discount codes, promotional offers and special pricing may be subject to additional conditions.

Unless otherwise stated, promotions cannot be exchanged for cash or applied retrospectively to previous purchases.

Cineflow reserves the right to cancel a promotion where fraud, abuse or an obvious pricing error has occurred.

15. Changes to These Terms

Cineflow may update these Terms from time to time to reflect changes to the website, products, licensing structure or applicable legal requirements.

The latest version will be published on the Cineflow website with its effective date.

Changes will not retrospectively remove rights already granted under a completed purchase unless required by law.

16. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute relating to these Terms, the website or a Cineflow purchase will be handled in accordance with applicable South African law and the jurisdiction of the appropriate South African courts.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
